The distinction between “exempt” employees, those to whom minimum wage and overtime requirements do not apply and “non-exempt” employees, those to whom such requirements do apply, is a source of litigation under the FLSA. Simply looking at job titles does not determine which employees are exempt or non-exempt. Classifying all salaried employees as exempt may not be appropriate under the law either.
